Le Creuset Malaysia Sdn. Bhd. with its business address at Suite 33-02, Level 33, Wisma UOA II, No. 21, Jalan Pinang, 50450 Kuala Lumpur, Malaysia (“Le Creuset”) is committed to protecting your personal data and your privacy, and this notice explains how we collect and process your personal data in accordance with Malaysia legislation on data protection, including the Personal Data Protection Act 2010 (the “Data Protection Laws”).



1. WHEN AND WHAT TYPE OF INFORMATION DO WE COLLECT FROM YOU

Personal data” means any information relating to you and that allows us to identify you, either directly or indirectly, alone or in combination with other information.

 

Children: This website is not intended for children (individuals under the age of 18) and we do not knowingly collect data relating to children.

 

We may collect personal data from you when you use our website (the “Website”), register a Le Creuset account, buy a Le Creuset product on the Website or in our stores or at any Le Creuset events, or subscribe to our marketing communications. The personal data may concern:

  • name, surname, date of birth, gender and other contact details (address, telephone number, and e-mail address), to register a Le Creuset account or purchase as a guest user, or to subscribe to our marketing communications.
  • your purchase data, for example date and time of purchase, delivery data, product and payment data and details, for managing your orders. The online purchases on the Website are managed by our partner E-Shop World. Please refer to E-Shop World privacy for purchases on the Website.
  • data about your online browsing history (e.g., online identifiers - such as your IP address, browser version, operating system, length of the visit, returning user, geographic origin), collected during your visits at the Website (whether you are registered user or not), by using logs and/or tracking technologies such as “cookies” (for information on data collection through cookies, please refer to Use of Cookies below), for improving our services and ads, or for our statistical analysis - in most cases we will not be able to identify you from this technical information.
  • your feedback, requests, complaints, questions, or interactions with us (for example your messages, chats, social media posts, emails or phone calls).
  • The personal data collected from you when you use the Website or otherwise provide personally identifying information is so protected and you have the privacy rights explained in paragraph 8) below.

3. WHY DO WE COLLECT THIS INFORMATION?

We may process your data for the following purposes:

  • FOR OUR LEGAL OBLIGATIONS We may have to process some data about you to fulfil our legal obligations and other obligations arising from instructions received from authorities.
  • TO CREATE A LE CREUSET ACCOUNT We will use your data to create a Le Creuset account which will give you access to a series of advantages dedicated to registered users, to better enjoy our services, such as faster checkout, save multiple shipping addresses, view and track orders, receive special coupons and discounts. Any processing activity is required to enable us to provide these services to you as a Le Creuset account holder.
  • TO MANAGE YOUR ORDERS AND PROVIDE OUR PRODUCTS, SERVICES, AND ASSISTANCE TO YOU We will use your data to manage our contractual relationship with you, your purchase of products, your use of the Website, any subsequent after-sales assistance, or your participation in our contests. We may have to process some data about you for our administrative purposes connected to our contractual relationship with you such as accounting, billing and audit, payment card verification, fraud screening, safety, security, systems testing, maintenance, and statistical analysis. Occasionally we may need to contact you for administrative or operational reasons. For instance, to send you confirmation of your purchase. We will also use your personal data to reply to your requests sent through our Website forms or other channels. This processing activity is required to enable us to provide our services to you. In the event you do not finalise the purchase within a certain period of time, no further follow up communications will be sent.
  • TO INFORM YOU ABOUT NEWS OR OFFERS ON LE CREUSET PRODUCTS If you have consented to us doing so (for example, by subscribing to our newsletter when you create an account on the Website or in our stores), we will send you personalised marketing communications and news about initiatives relating to Le Creuset promoted. We will contact you by email, SMS or social media, but also by using automated means. Such communications will relate to Le Creuset products or to new store openings, exclusive events, contests, surveys, demonstrations organised by Le Creuset or special offers that you may like. These communications may be selected or tailored for you based on details we hold about you such as your location or your purchase history, or preferences for our products. We will use your data to better understand your interests. This enables us to personalise our communications to make them more relevant and interesting. There will be no other effects. We also gather statistics around email opening and clicks using industry standard technologies to help us monitor our newsletters. This processing is based on your consent to receive personalised marketing communications from us. The opt-in choice may be exercised at the points where personal information is collected by selecting the appropriate checkbox or, if you have a Le Creuset account via the My Account section of the Website. 
  • Opt-out: You can stop receiving our updates at any time, free of charge, by clicking on the unsubscribe button at the end of any newsletter. If you have a Le Creuset account, you can easily manage your marketing preferences. If you prefer, you may do so by contacting us at enquiries.my@lecreuset.com. We will process your opt-out as soon as possible, but in some circumstances you may receive a few more messages until the opt-out is processed completely. Please, remember we do not pass or sell your contact details and other personal data to other companies for their marketing purposes.
  • RE-TARGETING / TAILOR OUR OFFERS AND IMPROVE CUSTOMER EXPERIENCE We would like to use your data to tailor our services and offers to your needs and preferences to provide you with a personalised Le Creuset customer experience. We will do this by analysing your habits or interests, for example, in relation to most viewed products, your interaction with us on social media, which pages of our Website you visit, which content of our offers you read. We do this mainly through cookies and similar technologies, also in combination with your data and preferences collected once you subscribe to our personalised marketing communications. We will use this information to manage our advertising on other sites, grant access to specific content, tailor the contents or the offers that you see on the Website or, if you have consented to subscribing to our marketing communications, to send you relevant communication/ message that we think you may like. There will be no other effects. The use of cookies is subject to your consent. If you wish not to have this information used for sending you interest-based ads, contents or communications, you can limit the usage of the information about your online actions by managing your cookie setting (however, please remember that certain cookies are necessary for using the Website). Please note this does not opt you out of being served ads, offers, or communications. You will continue to receive generic ads, offers, or communications. 4. HOW YOUR INFORMATION IS PROTECTED?

Security - We place great importance on the security of the data of our users. Le Creuset will take reasonable steps to ensure that your data is kept secure, only used for the purposes set forth in this privacy notice (and not for any other purposes), and it can be accessed or corrected upon your request. We use organisational, technical and administrative security measures to help protect against the loss, misuse and alteration of your personal data. Whilst we cannot guarantee any of these events will never occur, we use all reasonable efforts to prevent it.



5. TRANSFERS OF PERSONAL DATA OUT OF MALAYSIA

To provide you with the services described above, your data may be processed or stored both in and outside Malaysia to the European Economic Area (EEA) where Le Creuset Group and affiliated companies are located. Given the global nature of Le Creuset programs, some of the affiliated companies and partners of Le Creuset that act as processors may access your personal information and may be established in countries outside Malaysia such as Le Creuset Japan, Le Creuset China and in EEA where adequate protection according to European law are offered (as is the case of Switzerland where Le Creuset Group AG is based). You understand and consent to the transfer of your personal data outside Malaysia as described herein.

6. HOW LONG DO WE KEEP HOLD OF YOUR INFORMATION?

We will retain your personal data for as long as we need it for the purposes for which it was collected, after which it will be destroyed or rendered unusable. For example, we may have to keep data about your purchase to comply with our legal obligations or resolve disputes. Your Le Creuset account will be kept live until you request us to cancel it. We will keep your information for the purpose of providing you with newsletters, marketing communications and personalised contents for as long as you consent.



7. WHO MIGHT WE SHARE YOUR INFORMATION WITH?

Le Creuset staff – Your personal data will be processed only by our authorised staff of Le Creuset or by the authorised staff of other companies affiliates within Le Creuset group supporting us in providing you with the services described above.

Other companies working for us and our providers – Depending on the service, we may share your personal data with specialised companies which we entrust, on our behalf, as data processors, with duties of technical and organisational nature that are necessary to manage our relationships with customers and provide you the services described above. These include companies that provide storage services for documentation regarding customer relationships, providers of technical services, the payment gateway, our newsletter platform, companies that evaluate service quality and customer satisfaction, or carry out, on our behalf, marketing. These third parties will only access your information to perform tasks and duties in compliance with this Privacy notice and Data Protection Laws. Additionally, we may share your personal information with companies that support us in the provision of our services with other administrative or operational tasks, as autonomous controllers, such as our warehousing and distribution partners. These third parties will only use your personal data to the extent necessary to perform their specific functions for us. Legal obligations - We might have to disclose your information to third parties if this is necessary to (i) comply with laws and regulations; (ii) prevent fraud or misuse of our services; or (iii) protect Le Creuset’s business and property rights. These third parties may include legal services, audit services and local regulators and authorities.

Corporate transactions – We may transfer your personal data to third parties in the event of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets. 



8. IS PROVISION OF YOUR INFORMATION MANDATORY AND WHICH ARE THE CONSEQUENCES IN CASE OF REFUSAL?

It is necessary for you to provide us with some personal data in order to enable us to comply with our contractual obligations to you. Without your personal data, you may be unable to purchase products from us or register a Le Creuset account on the Website. It may be necessary for us to retain some of this data for the purpose of fulfilling our legal obligations. Providing personal data for marketing purpose, personalized contents and newsletter is optional. Not providing your data for these purposes will not have any negative consequences for you, however this means that we cannot provide you with Le Creuset personalised marketing communications and promotional offers. If you consent to Le Creuset processing your personal data for these purposes you can revoke your consent or object the processing at any time setting your cookie preferences, or emailing: privacy@lecreuset.com.

In the event of any conflict between the English and other language versions, the English version shall prevail.
